§1 General
For deliveries and services between OTECH-PBparts (seller) and the final customer (buyer)
apply exclusively the following terms and conditions.
§2 Offers and service acceptance
The commodity offered in our onlineshop is not binding. The contract becomes legally binding
by sending the offer in writing to the buyer. Contents of the offer in writing apply and the contract becomes effective.The delivery occurs according to the offer. If no other arrangement was met, written offers will lose their validity after 14 days.
§3 Prices
All prices in the onlineshop are inclusive tax plus shipping costs. Errors are excepted.
With OTECH-Pbparts there is no minimum order value. If there is no other written agreement
we deliver on advance payment. In the event of failure to comply with the payment deadline,
it is at OTECH-Pbparts discretion to either fulfill or void the contract.
§4 Delivery
The delivery occurs exclusively after monetary entrance, as far as no other arrangement was met. After dispatch of the goods the possibility of a cancellation is no longer existant. The dispatch occurs within 4 working days after monetary entrance.
§5 Right of revocation
You may revoke your contract within two weeks without further explanations in writing (e.g. letter, fax, e-mail) [or - if the goods have been sent you before the deadline – by sending back the goods]. The deadline begins after you receive this declaration in writing, but not before the arrival of the goods with the buyer (in case of recurring delivery of goods of the same kind not before arrival of the first partial delivery). To ensure the term of revocation it is sufficient to send the goods - or the revocation – in due time.

§6 Consequences of revocation
In case of an effective revocation the services received on both sides have to be returned.
If you can not return the goods as a whole or only partially or in worsened conditions you will have to compensate us. This will not come into effect if the deterioration of the goods is due to their examination – as you may have done in a retail store – which may be avoided by handling the goods not as if they were your own but with utmost care. Items that can be shipped in parcels may be sent back at our own expenses and risk. You have to pay the costs of the return if the delivered goods comply with what you have ordered and if the value of the returned items is below 40 Euro or if the value of the item is higher and at the time of revocation no payment or partial payment has been made by you. Items that can not be shipped in parcels we will fetch with you. Otherwise the return is free of charge for you.
Obligations to the allowance of payments must be fulfilled within 30 days. For you the deadline begins with the dispatch of your revocation (or the goods), for us with their receipt.
§7 Claim for defects
The buyer is obligated to examine the goods for defects upon their receipt and to claim them within 8 days. We will not take liability for defects due to iappropriate treatment, neglected maintenance or transportation damage. Other claims, in particular on substitute of the secondary damages which have not originated in the delivered products themselves, are excluded.
§8 Place of implementation and jurisdiction
Place of implementation is our place of business. In case of dispute the law in force is the german law to the exclusion of the UN-purchase right, even if you orer from a foreign country.
§9 Final clauses
The ineffectiveness of single regulations of the general terms and conditions of OTECH-Pbparts does not touch the validity of the remaining terms and conditions. Ineffective conditions will be replaced by legal regulations.
